1. Acceptance of Terms
By accessing or using FBIQ ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and VyznIQ LLC, a Texas limited liability company ("VyznIQ," "we," "us," or "our").
2. Description of Service
FBIQ is a football brain-training application that provides educational content, quizzes, and interactive features related to football rules, terminology, strategy, and gameplay. Some features require account registration or a paid subscription.
3. Eligibility
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. Users under 18 must have parental or guardian consent.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. VyznIQ reserves the right to suspend or terminate accounts that violate these Terms.
5. Intellectual Property
All content in the App — including but not limited to question banks, software code, graphics, user interface design, branding, and the "FBIQ" and "FBHoot" marks — is the exclusive property of VyznIQ LLC and is protected by United States copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, reverse engineer, decompile, disassemble, or create derivative works based on any part of the App without our express written permission.
6. Prohibited Conduct
You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the App; (b) scrape, harvest, or collect data from the App by automated means; (c) reproduce or redistribute App content for commercial purposes; (d) impersonate any person or entity; (e) use the App for any unlawful purpose; (f) interfere with or disrupt the integrity or performance of the App or its servers.
7. Subscriptions and Payments
Certain features require a paid subscription. Subscription fees are billed in advance on a recurring basis. All payments are processed through third-party payment processors. Subscriptions auto-renew unless cancelled before the renewal date. No refunds are provided for partial subscription periods except as required by applicable law.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VYZNIQ LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) $100.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in such courts.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the effective date above or by posting a notice in the App. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.

We may share information with: (a) service providers who assist in operating the App (Firebase, Stripe, Cloudflare) under confidentiality obligations; (b) law enforcement or legal authorities when required by law; (c) a successor entity in the event of a merger, acquisition, or sale of assets.

The App is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us information, please contact us and we will promptly delete it.
